Introduction

Welcome to Bimpco LLC. These Terms and Conditions, along with the Client Service Agreement contained herein, govern your access to and use of our graphic design services. By engaging our services, you agree to be bound by these terms.

We reserve the right to update these terms at any time without notice. Continued use of our services after any such changes constitutes your consent to such changes.

Services

Bimpco LLC specializes in graphic design, including logo creation, and the design of T-shirts, stickers, and promotional items, as further described in the individual project brief or contract entered into with the client. Each project will have its specific set of deliverables, deadlines, and requirements.

Intellectual Property Rights

Copyrights to the final designs are transferred to the client upon full payment. Bimpco LLC retains the right to use completed projects for promotional purposes. Unselected concepts and designs remain the intellectual property of Bimpco LLC.

Payment Terms

  • A quote will be provided for each project. A 50% non-refundable deposit is required to commence work. The balance is due upon project completion and before the final delivery of designs.
  • Payments are accepted via Wire Transfer, Check, Money Order, or via a Third-Party Payment Processor at the business's discretion.

Cancellation and Refund Policy

Cancellations must be made in writing. The deposit will not be refunded if cancellation occurs after work has commenced. No refunds are offered for completed work.
Cancellation Policy

  • Clients may cancel their projects by providing written notice to Bimpco LLC.
  • If cancellation occurs after the commencement of work but before the final approval of designs, the initial 50% deposit will not be refunded.
  • In cases where work has not yet started, Bimpco LLC may, at its discretion, refund the deposit minus any costs already incurred in preparation for the project.
  • Refunds are granted at Bimpco LLC's discretion and are primarily based on the extent to which work has progressed and in accordance with the cancellation policy.
  • Refunds related to disputes over design quality or adherence to the project brief will be considered on a case-by-case basis, aiming for a fair resolution.

Revisions and Approvals

The number of revisions will be specified in the project brief. Additional revisions may incur extra charges. Final approval must be in writing, and further changes post-approval may be subject to additional fees.

Requesting Changes to Designs

  • Clients may request changes to designs within the scope agreed upon in the project brief.
  • Any additional changes requested after final approval of a design may incur extra charges, which will be communicated and agreed upon before proceeding.
  • Bimpco LLC commits to working collaboratively with clients to achieve satisfactory results while ensuring fairness and respect for our design team's time and effort.

Liability and Indemnity

Bimpco LLC is not liable for indirect losses or damages arising from our services. Clients agree to indemnify Bimpco LLC against any claims or legal fees related to the content of the project materials.

Non-Acceptable Designs

  • Bimpco LLC reserves the right to reject any design requests that are deemed offensive, inappropriate, or contrary to our ethical guidelines and professional standards.
  • Decisions to reject a design request will be communicated to the client along with reasons for the rejection

Confidentiality

Both parties agree to keep project-related information confidential and use it solely for the purpose of the project.

Dispute Resolution

Disputes will first be attempted to be resolved through negotiation. Unresolved disputes will be settled through arbitration in the jurisdiction where Bimpco LLC is located.
